Victoria Legal Aid Section 29A panel firm
Being on the Victoria Legal Aid panel means the firm is approved to act for clients whose family law matters are funded by Victoria Legal Aid. If you have a grant of aid and would like to transfer it to us, or you think you might be eligible for one, we can act.
The criteria for whether you qualify is written by Victoria Legal Aid, not by this firm. They have set out a means and merits test that you must satisfy to qualify for a grant. If we are of the view you satisfy the means and merits test, we make the application to Victoria Legal Aid on your behalf.
If you are not eligible, that is worth knowing early rather than late. Tell us at the first conversation that funding is a concern and we will deal with it up front rather than at the point you receive a bill.
Section 102NA
Cross-examination in family violence matters
This is a different thing entirely, and it is not about funding your matter generally. The firm acts under the Commonwealth Family Violence and Cross-Examination of Parties Scheme under section 102NA.
The scheme applies where:
- a party in a family law matter cannot personally cross-examine, or be cross-examined by, the other party, and
- legal representation is required for that part of the hearing.
Where it applies, the cross-examination must be conducted by a lawyer rather than by the party themselves.
In practice that means someone who would otherwise have to question, or be questioned by, a person who has been violent towards them does not have to do it face to face. If you have been told the scheme applies to your matter, or you think it might, call and say so.
